North Dakota has given cities and counties local control to change speeding fines.
The disparities between cities and counties won’t be too severe, as the ND House amended the law to restrict fee-raising ability to twice the state’s levels.
In this podcast: Fargo Police Chief Dave Todd says he is in favor of raising some of the fines and is working with Fargo city attorneys on the issue.
Chief Todd says Mayor Mahoney has directed him to research the possibility with city attorneys and bring recommendations to the city commission.
Todd says he supports raising some of the fees, “We don’t have much deterrent value in driving behavior if we are stopping someone and giving them a $12 ticket”.
While Chief Todd says he supports doubling the fees for things like speeding, unlawful passing of a school bus, stop sign violations and texting and driving. There are some fines he believes just need to be updated. For example, the state allows you to fine up to $250 if someone were to disobey a temporary traffic device (in other words: going around a road block), and while Chief Todd doesn’t believe Fargo’s fine of $20 for that violation is enough, he wouldn’t support doubling it to $500. He says going up to the state level of $250 would make more sense.
After Chief Todd has finalized recommendations with city officials, he will bring them to the City Commission to be voted on.
