Farm Action issued the following statement in response to reporting that the Department of Justice is preparing to file an antitrust case against some of the largest egg producers in the country, following Farm Action’s investigation and calls for federal scrutiny of potential price gouging in the egg industry.
In a statement, Angela Huffman, Farm Action’s president and co-founder, said:
“Farm Action applauds the news that the DOJ is preparing to take action against the largest egg companies for alleged price gouging. For years, these corporations pointed to avian flu as justification for soaring egg prices, even as Farm Action’s investigation showed dominant firms were maintaining production while dramatically increasing prices and profits.
We urge antitrust enforcers to hold these companies accountable to the fullest extent of the law. Anything less risks allowing dominant firms to continue treating penalties as the cost of doing business rather than a deterrent for cheating the American people on a grocery store staple.”
Farm Action’s research findings on pricing practices in the highly consolidated egg industry helped trigger federal scrutiny, shifted public understanding of rising egg prices, and laid the groundwork for the enforcement action now being reported.
Beginning in 2023 and again in 2025, through formal letters to the DOJ and Federal Trade Commission (FTC) and detailed market analysis, the organization documented how a small number of dominant firms maintained steady production while dramatically increasing prices and profits during the avian flu outbreak. Less than a month after Farm Action’s 2025 letter to federal regulators, the DOJ opened an antitrust investigation into the egg industry.
