FARGO (KFGO/KVRR) — The jury in the Spencer Moen murder case has heard closing arguments and are now deliberating.
The prosecution stressed the amount of time between Spencer Moen taking a video of his wife, Sonja, lying in a bathtub and when he called 911, saying it showed callous disregard for Sonja’s life.
The defense argued that the prosecution made a mistake in charging Spencer Moen with murder and that they should have charged him with negligent homicide.
“He didn’t call police right away because he didn’t not value Sonja’s life. He valued Spencer. Sure, he might have been scared, he might have realized he went too far, but he wasn’t concerned enough for Sonja to call for help,” said the prosecutor.
“We gave you the reason, we gave you the way out, and the way out is find him guilty of negligent homicide,” said Moen’s lawyer.
Deliberations will resume at 9 a.m. Wednesday.

A jury is deliberating the fate of Spencer Moen of West Fargo.
Moen is accused of killing his wife, Sonja Moen, in their West Fargo home last year.
He was arrested in August 2023 after calling to report that his wife Sonja fell asleep in their bathtub and was unresponsive.
An autopsy showed that she died of blunt force trauma to the head and had at least one broken rib.
Moen pleaded not guilty to the murder charge last October.
Two of those to take the stand were the Moen’s young kids as well as Sonja’s mother Kristin Scofield.
While on the stand, she testified that she talked with her daughter about drinking too much as well as saying she believed Spencer to be an alcoholic.
She believed that Spencer killed her daughter.
