FARGO (KFGO) – Fargo Police Chief Dave Zibolski said in an interview with KFGO News & Views Thursday that while there was an initial misdemeanor domestic violence warrant issued last month for the arrest of the man who on Wednesday shot both the woman he previously assaulted and her baby at a south Fargo restaurant, officers were initially under a timeline to find 24-year-old Malik Gill. Zibolski said such warrants are only active for a short period of time. The Cass County State’s Attorney issued a subsequent warrant on April 25, which was still active at the time of Wednesday’s shooting.
“Domestic violence is an exception, but it only allows us 12 hours to make that arrest,” Zibolski said. “So a guy like this can assault his domestic partner and if he eludes our capture for more than 12 hours, the only thing we can do is refer it to the state’s attorney for review, and then they review it and decide what they’re going to do.”
The 21-year-old Moorhead woman Gill shot remains in intensive care in critical condition at a Fargo hospital. The 9-month-old baby was shot in the hand and thigh and is in stable condition.
Gill stole an SUV from a south Fargo home after fleeing the restaurant. He then shot and killed himself south of Hawley, MN, following a pursuit with Clay County deputies. Law enforcement was tracking him using the stolen vehicle’s OnStar technology.
Zibolski said Fargo police, along with state and federal investigators are working to determine where Gill, who is a felon, got the handgun he used in Wednesday’s shootings.
“This is an individual who should not have access to or be in possession of a gun and that’s still going to be an open investigation. We will fully investigate with state and federal partners how he got this firearm and anyone that violated the law we will refer for prosecution because at the end of the day, him having that firearm is what led to this really heinous event happening,” Zibolski said.
Gill’s previous felony conviction was in Moorhead.
