FARGO (KFGO) – The North Dakota Attorney General’s office has declined to issue an opinion requested by the Fargo City Commission on the legality of a city law that prohibits gun sales in residential neighborhoods by licensed dealers.
The opinion was requested in June after heated city commission debate from gun dealers who want the 19-year-old ordinance changed.
The planning commission had earlier voted to oppose the change, which allows home sales of firearms. The attorney general’s opinion said it was up to the city attorney to interpret the ordinance. City Commissioner Tony Gehrig calls Fargo’s ordinance “wrong and anti-gun.”
Gehrig points out that both local and federal authorities have had no problems with the small number of licensed dealers.
Gehrig said the attorney general’s response will be discussed at Monday’s commission meeting and he will call for a public hearing on the issue at the August 24 commission meeting.
