For those who have never heard of “sampling,” the concept is pretty simple. An artist takes a section of another song and adds it to theirs.
For example, Kid Rock sampled “Sweet Home Alabama” during his song “All Summer Long” with both lyrics and music.
Most see this as an homage and can be complimentary to what other great musicians have created – but those who are being sampled don’t always feel like they are being honored. They want to get paid.
Ryan Jackson is a professor at MSUM in The School of Entertainment Industries and Technology. Ryan educates students when it comes to choices of copyright and how the line seems to be changing in the music industry as far as sampling.
After a four-year court battle, Katy Perry’s 2013 hit “Dark Horse” has been found, by a jury, to have infringed on Marcus Gray’s copyright in his 2008 track “Joyful Noise.” $2.8 million in damages have been assessed.
A few years ago, the estate of Marvin Gaye successfully sued the musicians behind the Robin Thicke hit tune “Blurred Lines” and walked away with roughly $5,000,00.
Ryan brings an industry knowledge to our conversation and notes that the music industry is ever changing and this could be a tipping point that could change how music is made from here on out.
