FARGO (KFGO) – The former CEO of EPIC Companies Todd Berning is being sued for money owed, but so far, he can’t be located to be served papers.
A lawsuit was filed against Berning by 7Seven Property Partners, a Minot-based company, for money due on September 6th. Court records show multiple attempts to serve Berning have been unsuccessful. Servers tried to find Berning at an apartment in Fargo and a home in West Fargo, then at an apartment in St. Louis Park, Minnesota. Berning was not at any of those addresses.
On September 11, a judge agreed to serve Berning through the mail.
In May, EPIC Companies suddenly closed, laying off employees. In July, the company filed for bankruptcy. Many contractors and investors are owed money; some are owed thousands of dollars.
