ST. PAUL, Minn. – The Minnesota Court of Appeals has rejected a man’s request to overturn his conviction because a support dog was allowed in court. Jairo Fernandez-Sorto was convicted of first-degree criminal sexual conduct in Stearns County last year.
The judge in the case allowed the 15-year-old victim to have a support dog in the courtroom over the objections of the man on trial, who was later sentenced to 30 years in prison.
Fernandez-Sorto appealed, saying the court abused its discretion in allowing the dog into the courtroom.
The Court of Appeals dismissed the case saying the judge did nothing wrong by allowing the dog in court.
