MINNEAPOLIS (KFGO) – A Stillwater man who has spent nearly 18 years in state prison will be released.
A judge overturned his murder conviction after new technology showed he did not shoot and kill a man in 2008.
Jerrell Brown, 38, was convicted of aiding and abetting in the death of Darius Miller. During Brown’s trial, the Hennepin County Attorney’s office argued that while ballistics analysis was inconclusive, there was enough circumstantial evidence for the jury to find Brown guilty. A new ballistics analysis, not available at the time of the trial, shows that Brown could not have fired the bullet that killed miller.
County Attorney Mary Moriarty says while Brown was at the scene of the shooting, freeing Brown is the only acceptable course of action. No one else has been charged in the murder.
