SIOUX FALLS, S.D. (KFGO) – The family of a child with a disability will be paid over $20,000 after the child, who is part of the Sioux Falls Children’s Chorus, was denied the opportunity to perform with the classic rock band Foreigner.
The child uses a wheelchair and was to perform a song that Foreigner planned during a 2024 concert at Denny Sanford PREMIER Center. The U.S. Justice Department says it reached a settlement with Counter Productions, Inc. for its staff not making reasonable accommodations that would have allowed the child to sing with her friends.
Counter Productions claimed the staging area was too hazardous for the girl even though PREMIER Center staff, members of the Children’s Chorus, and the child’s parents proposed options.
The Justice Department says the company violated Title III of the Americans with Disabilities Act. Counter Productions agreed to pay the family $23,500 and adopt new ADA compliance measures.
U.S. Attorney for South Dakota Ron Parsons says none of the members of Foreigner were responsible for the violation and were not aware of the situation.
