FARGO (KFGO) – The Occupational Safety and Health Administration is issuing five citations and fining a Fargo company over $26,000 after a man was killed in a work-related accident last year.
Tuah Kollie died July 24 at Mid America Steel in the industrial park.
KFGO News requested the results of OSHA’s investigation through the Freedom of Information Act.
Mid America Steel was cited for permitting an employee to operate a powered industrial truck before ensuring they completed required training, for not ensuring that each operator had successfully completed required training, for loads being handled that exceeded the rated capacity of industrial trucks, and for loads that may exceed capacity not being adjusted. Two of the violations drew fines of $13,240.
Mid America Steel has until next Thursday to take corrective action laid out by OSHA. It can also appeal the fines.
Company president Jaeden Pederson issued the following statement to KFGO News.
“Mid America Steel is reviewing OSHA’s findings in detail. As part of the standard process, the company continues to work with OSHA and is determining the appropriate next steps, including the options available under federal regulations. Mid America Steel has cooperated fully with OSHA throughout the process and will continue to do so as the process moves forward. As this is an ongoing regulatory process, the company will not be providing additional details at this time.”
