GRAND FORKS, N.D. (KFGO) – A district court judge has decided that a chemical DUI test taken after a crash west of Grand Forks that seriously injured a woman and led to the death of her 6-year-old daughter cannot be used against him.
Travis Bell, 44, is charged with vehicular homicide and vehicular injury in the collision last June.
Bell’s attorney, Mark Friese of Fargo, argued that the chemical test should not be admissible.
A Northeast District Court Judge has ruled that a state trooper made statements to Bell that convinced him to consent to the chemical test.
The judge said the consent was involuntarily coerced and must be suppressed.
26-year-old Nicole Louthain was seriously hurt in the collision. Her daughter later died of her injuries. Bell is accused of running a red light and running into Louthain’s vehicle at the intersection of Airport Road and US Highway 2.
Bell’s trial has been scheduled for August.
