DETROIT LAKES, Minn. (KFGO/WCCO) – Lawyers for Democratic State Sen. Nicole Mitchell are asking that her Becker County burglary trial be delayed until late spring, after the upcoming legislative session adjourns.
The motion was filed Friday as her trial is supposed to get underway on Jan. 27. The legislative session is scheduled to begin on Tuesday.
Mitchell was arrested last year at her stepmother’s Detroit Lakes home. She was charged with burglary and is accused of taking several items that she said belonged to her late father. Mitchell pleaded not guilty and claims it was a misunderstanding.
Senate Republican Leader Mark Johnson released a statement saying Mitchell needs to be held accountable for her actions and she should resign.
“Sen. Mitchell’s motion today delays justice for her victim and further delays an orderly Senate session as she continues to bring the reputation of the Senate into disrepute,” says Johnson. “The Senate cannot tell the Judiciary what to do, but we can and should hold our own members accountable. Senate Republicans stand by our previous votes to not allow her to vote, to not count her vote, and to remove her from the body. We expect the Senate Democrats who called for her resignation will join us in our efforts this session.”
