HILLSBORO, N.D. (KFGO) – The former CEO and founder of Epic Companies and his wife of 15 years are getting divorced.
A marital termination agreement in Traill County says Todd Berning will retain a condominium in Minot while Carolyn Berning will keep their marital home in West Fargo.
The filing says irreconcilable differences arose between them that have destroyed the legitimate objects of the marriage and make the continuation of the marriage impossible and intolerable. Neither will pay spousal support. Carolyn Berning will be released from all liability associated with any investments related to Epic Companies. She will also be allowed to use her maiden name. The Berning’s will also pay their own legal feels related to the divorce.
Epic suddenly closed in May and sought bankruptcy protection in July. Debts of associated companies total hundreds of millions of dollars. Investors are in several states.
Epic developed commercial and residential properties in both North Dakota and Minnesota. Most have been transferred to new management. While several actions have been taken in civil court, Todd Berning has not been criminally charged.
