FARGO (KFGO/KVRR) โ A federal judge has ordered attorneys to file briefs regarding whether former State Sen. Ray Holmberg should be taken into custody while he awaits his sentence after pleading guilty to traveling to Europe to pay for sex with children.
Holmberg has been allowed to remain free, but federal prosecutors want Judge Daniel Hovland to consider jailing Holmberg because he violated the terms of his release several times.
During a telephone conference call, Assistant U.S. Attorney Jennifer Puhl called Holmbergโs behavior โflippantโ and said Hovland could revoke the release, based on the violations.
Holmbergโs alleged violations included accessing social media and stopping at a home in Fargo without permission.
But defense attorney Mark Friese said Holmberg was checking online news accounts about his case. He also said the home in Fargo where Holmberg stops is his sisterโs residence.
Attorneys have until next Tuesday to submit arguments. Holmberg remains on supervised release until a final determination is made.
