FARGO (KFGO) – A request for a 120-day extension for the demolition of a condemned house at 924 5th Street South in Fargo, owned by Danial Curtis, has been denied by city commissioners.
Curtis has been at odds for some time with the city and the building inspections department about his house, considered uninhabitable and unsafe. Curtis cited the weather, lack of proper notice of action being taken, and an alleged violation of his constitutional rights. He spoke to city commissioners before the final vote demanding to know how the city could come in, take his property away and demolish his house.
City Inspections Director Shawn Ouradnik said proper actions were all given within the timelines stipulated for appeals during the dangerous building process and proper notices were given for all actions taken by the inspections department for his property
In September, the commission voted to order the house vacated immediately and torn down in November. Curtis refused to leave and filed an appeal to the North Dakota Supreme Court in Oct. The court determined that his legal brief was insufficient and dismissed the appeal. The city then approved a contractor to demolish the house and garage in January.
