FARGO (KFGO) – A Fargo man has been charged with murder in the drive-by shooting death of a man in south Fargo in 2020.
According to the Cass County State’s Attorney’s Office, a cooperating defendant said Joshua Brooks, 30, planned the shooting and was the driver when Santino Marial was killed and two others were hit by gunfire on the night of Aug. 28, 2020.
The cooperating defendant told detectives Brooks asked him to ride along with Brooks to “go holla at some people.” The cooperating defendant said he thought it meant they were going to fight someone if they didn’t pay a debt.
According to the cooperating defendant, as they drove by the three victims, who were standing in an open garage at an apartment complex at 1104 44th Street S., Brooks pointed out Marial as the person they were looking for. They circled the apartment complex and back to the garage. As they drove by the second time, shots were fired.
Multiple bullets were recovered from the scene.
One of the victims and other witnesses identified the make of the car the suspects used. The cooperating defendant, who worked with detectives earlier this year, verified the make and model of the car and shared details only known to investigators.
Marial had two young daughters.
Brooks has been charged with murder and aggravated assualt. He faces up to life in prison and is being held on a $1 million cash bond.
His next court appearance is scheduled for Nov. 2.
