Let’s face it, the legal system is confusing…on a good day. During the COVID-19 pandemic there have been changes that make it ever more frustrating to navigate the legal world.
Ashley Heitkamp and Ross Nilson from Nilson Brand Law gave It Takes Two with Amy and JJ some of their time to discuss how their day-to-day has shifted and answer questions from KFGO listeners.
The biggest change clients and their lawyers are seeing is court dates. Having to push meetings and court dates in a system that is already packed.
Ross Nilson makes mention, in some cases, July might be the first time proceedings will take place outside of update meetings.
Listeners chimed in with questions pertaining to custody, estate planning, lease terminology and more.
For example, a frustrated KFGO streamer asked about a spouse who would not share custody and refused to drop off children during the pandemic. Ashley Heitkamp says in the state of North Dakota – it’s business as usual. You are still required to fulfill the agreed upon court order of custody. If changes need to be made, make sure you are taking screen shots of your communication by text or email and not trusting a handshake or verbal agreement. Always be prepared to backup your statement!
In the case of eviction, the lawyers recommended that you read through the lease you signed. Is there verbiage about force majeure. Reading a lease BEFORE you sign it is always the best course of action – but adapting to the changing needs of businesses can be a a discussion between landlord and tenant that is better now versus later.
