Werner Kunkel
DEVILS LAKE, N.D. (KFGO-KZZY) — During a court hearing in Devils lake Monday afternoon, Ramsey County State’s Attorney Daniel Howell informed the judge that the state would be appealing an order granting Werner Kunkel a new trial.
Last month, District Judge Daniel Narum ordered a new trial for Kunkel. He was convicted in 1995 of murdering Gilbert Fassett in 1986. He was sentenced to life in prison.
There are claims the prosecutor at the time of the original trial didn’t turn over evidence to the defense as required. Others testified during a two-day hearing they saw Fassett alive days after he was supposedly murdered by Kunkel. One witness said they saw Fassett alive while Kunkel was being held in jail for murder.
Kunkel’s defense team informed the judge they will rescind their request for his release from custody pending the new trial.
