ST. PAUL – The Bureau of Alcohol, Tobacco, Firearms and Explosives is advising Minnesotans who plan to use marijuana after it becomes legal on August 1st that they will no longer be able to possess, ship, transport, or receive firearms or ammunition because marijuana remains an illegal, controlled substance under federal law.
Republican Representative Marion O’Neill from Maple Lake warned of that situation during a Minnesota House floor debate on the cannabis bill, saying the Biden administration appealed after federal judges in Oklahoma and Texas ruled the restriction unconstitutional.
It remains an open question whether federal officials would prosecute someone solely for using marijuana and possessing firearms.
ATF officials are also reminding those with a federal license to sell firearms that it’s illegal to transfer a firearm if they have reasonable cause to believe that the person uses marijuana.
