FARGO - (KFGO AM) -- Two people charged in a Cass County drug case will not be able to use the argument that they had a right to have marijuana because it was prescribed to them in another state.
The decision from District Judge Wickham Corwin comes in the case against Brian Kuruc and Rebecca Larson. They say prescriptions for medicinal marijuana issued in Washington state allowed them to have it in North Dakota.
Judge Corwin's ruling says that the argument cannot be used as their main defense or be part of the instructions to the jury, but the "evidence may be admissable for some other purpose as future developments warrant."
Kuruc and Larson were arrested in January with nearly 13 oz. of pot at a Casselton motel.
They're scheduled for trial later this month.
