FARGO, ND (KFGO NEWS) -- The Cass County Sheriff's Office says the future of 170 dogs seized from a breeder near Wheatland last could depend on a court's decision.
Investigators say the breeder, Darcy Smith, has until Friday to demand a trial to keep the dogs.
If he does, it will then be up to the court to decide who should have ownership.
If the county gains ownership, the sheriff's department will start adopting the dogs out.
Captain Mitch Burris says after nearly a week under vet care, most of the dogs are looking much better, having passed their wellness checks and had their vaccinations:
Cass County prosecutors still have not decided on charges against Smith.
